Because you are hi-jacking the clone it still has all the muscle memory and skills from the person's body you took. So if they have crappy reload skills you get that as well. Your battle knowledge won't transfer unless you hit a supply depot and refit.
Muscle memory is built up in the brain, despite the wording. This is why your consciousness can jump from clone to clone and they all have your skills. You didn't bring them, you didn't pay for them, the clones are generic bodies supplied by the contract writer. So you would retain all of your skills, which could render an opponents equipment useless in your hands. Perhaps you could only spawn into it if you have the skills to use it. This would encourage diversified skill sets and make it balanced to use. I assume there would be a time limit on how long you can upload into them..
As for who loses a clone: that sad consciousness you evicted when he checks out another clone to respawn. It just wouldnt cost your team a clone when you spawn this way. So using it to troll is pointless, as then youd have to use a clone to spawn again without the uplink. The injector guy would get a special type of kill bonus for opening that window.
I assume higher tuners would take less time to inject and last longer. Or being new tech it wouldn't have tiers yet..

The kill is registered when the clone mind is pushed from the body back to the battle server. So at the moment you or a team mate spawns into that body the kill is registered and death is recorded. But what happens when the hijacked body dies? Does that count as a death for the hijacker or another death for the one hijacked?
I covered that. The injected gets a death on being shunted, the invader gets a death on dying.

I don't think you lot realize what the needle does, it doesn't bring you back to life, it floods your system with nanites that will keep your body running for just a little long, but it damages your brain and in addition to the radiation this body received just from spawning in you won't live long after the match is over (if this body survives till the end).
a needle is not putting your brain back in your body. a needle is not bringing you back to life. a terminated clone immediately begins to "decay" a clone's neural implant fries the brain when the clone dies, making the body useless. a still functioning clone has encryption to protect themselves from being hacked (and if they didn't, there'd be no point to fighting, just hack the other team from orbit.)
I won't deny the idea is cool. it just doesn't fit in Dust.
you can try to make the argument for Sansha nanites, but I'm fairly certain that is against CONCORD conventions, and would not be available to DUST mercs.
All this would do is create a hole in the neural uplink encryption, allowing someone else to take over the clone
